Pine City banner
editThat's a nice banner you put up on Pine City, but unfortunately, that sculpture is copyrighted and cannot be depicted in a free photograph. We can still use the banner, but it can't be hosted at Commons; it has to be hosted locally, here on the English Wikivoyage, per our Wikivoyage:Non-free content policy. Response: This photo, and the sculpture contained within it, are not copyrighted. The photo is my own work. The sculpture was carved by Dennis Roghair and is property of the City of Pine City, where I am an employee. can you explain how this is copyrighted?—The preceding comment was added by 24.111.45.78 (talk • contribs)
- It is usual for the artist to retain copyright on sculptures commissioned in this way; the fact that the city owns the sculpture does not automatically mean that they own the copyright to the sculpture. (And even if Pine City did own the copyright, we would still need explicit permission from Pine City to use the image under a free license.) As with most legal issues, it can get kinda hairy and it's hard for non-experts to follow the reasoning sometimes (I'm no expert myself). The upshot, though, is this: Commons has to assume that the sculpture is copyrighted unless presented with solid evidence to the contrary. LtPowers (talk) 00:23, 8 November 2013 (UTC)

Hi. I take no position on whether Pine City should be listed instead of Pipestone, but before you make that replacement again, please post your argument on Talk:Minnesota and see if you can get a consensus behind it. Thanks!
